1. About These Terms 

1.1 These Website Terms (“Terms”) set out the basis on which you may access and use the Mammoth Salvage website (the “Site”). 

1.2 By using the Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Site. 

1.3 Where you are acting in the course of a business, these Terms apply to the exclusion of any other terms that you may seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing. 

2. About Mammoth Salvage and the Buyer 

2.1 Mammoth Salvage is a trading name used in connection with asset purchasing services. 

2.2 All offers, purchase transactions, collections and payments are made by Redcorn Limited, a company registered in England and Wales with company number 02768567 and registered office at Units 3/4, Kerry Avenue, Aveley, Purfleet-On-Thames, South Ockendon, RM15 4YE. 

2.3 If you accept an offer, your agreement will be with Redcorn Limited, who will arrange collection and payment. You may therefore be contacted by, and deal directly with, Redcorn Limited. 

2.4 In these Terms, “we”, “us” and “our” refer to Redcorn Limited. 

3. Description of the Service 

3.1 The Site enables you to submit details of commercial vehicles, plant, machinery and other assets (the “Assets”) that you are considering selling. 

3.2 Based on the information you provide, we may issue a non-binding quote for the purchase of an Asset (a “Quote”). 

3.3 The Site is intended primarily for businesses disposing of Assets in the course of trade. If you are acting as a consumer, additional rights may apply (see clause 12). 

4. Requesting a Quote 

4.1 To request a Quote, you must provide accurate and complete information about the Asset, including (where applicable): 

    (a) type, make, model and specification;
    (b) condition and operational status;
    (c) location and accessibility; and
    (d) ownership and legal status. 

4.2 You are responsible for ensuring that all information provided is true, accurate and complete in all material respects. 

5. How Quotes Work 

5.1 Any Quote: 

    (a) is based on the information you provide;
    (b) may include assumptions where information is incomplete; and
    (c) is not legally binding unless and until accepted and confirmed by us. 

5.2 The price offered in a Quote may be: 

    (a) a payment made to you;
    (b) zero (no payment by either party); or
    (c) a fee payable by you. 

5.3 Any price (including any fee payable by you) will be clearly stated in the Quote before you decide whether to proceed. You will not be obliged to proceed unless you accept that price. 

6. Accepting a Quote and Contract Formation 

6.1 You may accept a Quote via the method specified by us (including via the Site, email or telephone). 

6.2 A legally binding agreement is formed only when we confirm acceptance of your order. 

6.3 Until that point: 

    (a) any Quote may be revised or withdrawn; and
    (b) no legally binding contract exists. 

7. Accuracy of Information 

7.1 All Quotes are based on the information you provide. 

7.2 If: 

    (a) any information is inaccurate, incomplete or misleading; or
    (b) the Asset differs materially from the description provided, 

then we may: 

    (i) withdraw the Quote; or
    (ii) issue a revised Quote. 

7.3 You will always have the opportunity to accept or decline any revised Quote before proceeding. 

8. Collection and Logistics 

8.1 Where collection is agreed: 

    (a) we will arrange collection at a mutually agreed time; and
    (b) any collection time provided is an estimate only and is not guaranteed. 

8.2 You must ensure that the Asset is: 

    (a) accessible;
    (b) safe to load and recover; and
    (c) available at the agreed location. 

8.3 Collection arrangements are made to enable completion of the transaction and do not constitute a standalone service. 

8.4 We shall not be responsible for delays, failed collections or additional costs arising from: 

    (a) access restrictions;
    (b) unsafe or unsuitable conditions; or
    (c) incorrect or incomplete information provided by you.
and we may recover any reasonable costs incurred as a result. 

9. Your Obligations 

9.1 By using the Site and proceeding with a transaction, you confirm that: 

    (a) you have the legal right to sell or dispose of the Asset;
    (b) the Asset is free from finance, charges or third-party interests unless disclosed;
    (c) you have full authority to enter into the transaction; and
    (d) all information you provide is accurate. 

9.2 You agree to: 

    (a) cooperate reasonably in all matters relating to the transaction;
    (b) provide access for inspection and collection; and
    (c) provide any documents or information reasonably required. 

10. Changes, Withdrawal and Discretion 

10.1 We may: 

    (a) withdraw or amend a Quote at any time prior to contract formation; and
    (b) decline to proceed with a transaction at our discretion. 

10.2 You may decline any Quote or revised Quote at any time before a contract is formed. 

11. Liability 

11.1 To the fullest extent permitted by law: 

    (a) the Site is provided on an “as is” and “as available” basis; and
    (b) we make no warranties or representations regarding the accuracy or completeness of information on the Site. 

11.2 We shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for: 

    (a) loss of profit;
    (b) loss of sales, business or revenue;
    (c) loss of agreements or contracts;
    (d) loss of anticipated savings;
    (e) loss of use or goodwill; or
    (f) any indirect or consequential loss. 

11.3 We are not liable for any reliance placed on a Quote prior to a legally binding contract being formed. 

11.4 Nothing in these Terms limits or excludes liability for: 

    (a) death or personal injury caused by negligence;
    (b) fraud or fraudulent misrepresentation; or
    (c) any liability which cannot be excluded or limited by law. 

12. If You Are a Consumer 

12.1 If you are an individual acting outside the course of a business: 

    (a) you have certain legal rights that cannot be excluded or limited; and
    (b) nothing in these Terms affects those rights. 

12.2 Any provision of these Terms shall be interpreted accordingly where required by applicable law. 

13. Acceptable Use of the Site 

13.1 You agree not to: 

    (a) use the Site for any unlawful purpose;
    (b) submit false or misleading information; or
    (c) attempt to interfere with or disrupt the operation of the Site. 

13.2 We may suspend or terminate access to the Site where these Terms are breached. 

14. Entire Agreement 

14.1 These Terms set out the entire agreement relating to your use of the Site and supersede any prior discussions, representations or understandings. 

15. General 

15.1 These Terms are governed by the law of England and Wales. 

15.2 The courts of England and Wales shall have exclusive jurisdiction, except where consumer law provides otherwise. 

15.3 If any provision of these Terms is found to be invalid or unenforceable, the remainder shall continue in full force and effect.
